These Terms of Service ("Terms") govern your access to and use of Nousify.ai (the "Service"), operated by Nousify.ai ("we," "us"). By creating an account or using the Service, you agree to these Terms. Together with our Privacy Policy, Refund Policy and Data Processing Agreement, they are the whole agreement between you and us about the Service. Nobody else, including a partner or affiliate who recommended the Service to you, can change them or make promises on our behalf.
Nousify.ai helps businesses find leads and manage Instagram outreach and conversations, including through an official connection to the Instagram Platform and, optionally, a browser extension. You are responsible for how you use the Service, including the content of any messages you send.
You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for activity that happens under your account.
When you connect an Instagram account to Nousify.ai, you authorize us to access and act on that account through Meta's official APIs (and, where applicable, our browser extension) as described in our Privacy Policy. You confirm that you are authorized to connect that account and that doing so does not violate Instagram's or Meta's own terms and policies.

Where we process personal data on your behalf, our Data Processing Agreement applies and forms part of these Terms. If you use Nousify.ai for your own clients, it also governs our role as your sub-processor.
Paid plans are billed on a recurring basis as described at signup. You can cancel at any time; cancellation takes effect at the end of your current billing period unless stated otherwise. All payments are final - see our Refund Policy.
Instagram accounts belong to Meta's platform and are governed by Meta's own terms. Meta alone decides whether to limit, restrict, suspend, disable, or remove an account, and it can do so at any time and for any reason. We have no control over those decisions and cannot reverse them.
Outreach, messaging, and lead finding on Instagram, whether automated or assisted, can lead Meta to take action against an account, however carefully the Service is used. By connecting an Instagram account and using the Service, you confirm that you understand this risk and accept it in full.
To the maximum extent permitted by law, we have no responsibility and no liability for any action taken against an Instagram account connected to or used with the Service. This includes limits, restrictions, suspensions, bans, and the disabling or removal of an account, and anything that follows from them, such as lost followers, content, conversations, leads, customers, revenue, or business.
An account being limited, restricted, or lost does not entitle you to a refund, credit, or compensation. See our Refund Policy.
The Service is provided "as is" and "as available," without warranties of any kind. We do not promise any particular result from using it, including leads, replies, booked calls, or sales. Instagram and Meta may change or restrict their platforms at any time in ways outside our control, and we do not guarantee uninterrupted access to any third-party platform.
To the maximum extent permitted by law, Nousify.ai is not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service.
To the maximum extent permitted by law, our total liability for all claims relating to the Service is limited to the amount you paid us for the Service in the three months before the claim arose.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you.
We may update the Service and these Terms over time. We will update the "Last updated" date above when we do, and material changes will be communicated to active account holders.
